Terms of Service

These Terms of Service ("Terms") govern your access to and use of the RecruitBrain platform operated by RecruitBrain ("we," "our," or "us") at recruitbrain.ai. By creating an account or using our services, you agree to these Terms.

1. Acceptance of Terms

By accessing or using RecruitBrain, you agree to be bound by these Terms and our Privacy Policy. If you are using the platform on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Service Description

RecruitBrain is an AI-powered recruitment screening and knowledge base platform. Our services include:

• Document upload and storage (CVs, job descriptions, client briefs)
• AI-powered candidate data extraction
• Candidate-role matching and scoring
• Knowledge base search and Q&A
• Pipeline dashboards and reporting

We reserve the right to modify, suspend, or discontinue any part of the service with reasonable notice.

3. Accounts

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@recruitbrain.ai if you suspect unauthorized access.

4. Billing and Payments

Paid plans are billed monthly in advance through Paddle. All fees are in US dollars and are non-refundable unless otherwise stated. You may upgrade, downgrade, or cancel your subscription at any time through your account settings.

Free trials provide full access to Pro plan features for 14 days. If you do not subscribe before the trial ends, your account will revert to limited functionality.

We may change our pricing with 30 days written notice. Price changes apply at the start of the next billing period.

5. Your Data

You retain all rights to the documents and data you upload to RecruitBrain. You grant us a limited license to process, store, and analyze your data solely to provide and improve our services.

You are responsible for ensuring you have the right to upload and process any documents, including candidate CVs. You must comply with all applicable data protection laws, including GDPR where applicable.

We do not use your documents to train AI models. Your data is processed by our AI providers (Google and OpenAI) solely for the purpose of delivering our services.

6. Acceptable Use

You agree not to:

• Use the platform for any unlawful purpose
• Upload malicious files or content
• Attempt to access other users' data or workspaces
• Reverse engineer, decompile, or disassemble the platform
• Resell or redistribute the service without authorization
• Exceed your plan's usage limits through automated means
• Use the platform in a way that could harm or impair its operation

7. Intellectual Property

RecruitBrain and its original content, features, and functionality are owned by us and protected by intellectual property laws. Our name, logo, and branding are our trademarks and may not be used without prior written consent.

AI-generated outputs (extractions, screenings, search results) based on your data are considered part of your data and belong to you.

8. Limitation of Liability

RecruitBrain is provided "as is" without warranties of any kind, whether express or implied. We do not guarantee that AI-generated results will be accurate, complete, or error-free.

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the platform.

Our total liability for any claims arising from these Terms or the use of our services shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Termination

You may close your account at any time. We may suspend or terminate your access if you violate these Terms, fail to pay, or engage in activity that could harm the platform or other users.

Upon termination, your data will be retained for 30 days to allow for export, after which it will be permanently deleted.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the platform. Continued use after changes take effect constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of the jurisdiction in which RecruitBrain operates. Any disputes shall be resolved through good faith negotiation first, and if necessary, through binding arbitration.
